According to TMZ on Jan. 29, Valentin Chmerkovskiy, professional dancer on “Dancing with the Stars,” is being sued for $6 million for posting a photo of an overweight 16-year-old girl with Down Syndrome. The document for the lawsuit claims Chmerkovskiy caused severe emotional distress to Skylar Eden when he posted a picture that mocked her on his social media pages. The one-time “Dancing with the Stars” champion has millions of followers on Instagram, Facebook, and Twitter. Therefore, the photo he posted, along with his comment, went viral.
Actually, the younger brother of Maksim Chmerkovskiy, did not post the original photo or make the original comment. The girl admitted that in 2008 someone took the picture of her drinking a large soda at a baseball game. The picture was posted with the comment that read, “Everything that’s wrong with America.” In 2014, the photo was still being circulated online. Val re-posted the picture three weeks ago with his own caption that read, “Letting your kid become obese should be considered child abuse.”
This time, the Tennessee parents contacted Chmerkovskiy to take down the picture. Gossip Cop reported that the 29-year-old dancer criticized the parents, but he did remove the picture. However, he continued his fat-shaming conversation on social media.
The legal documents claim CBS News also posted the photo. Therefore, Valentin Chmerkovskiy is being sued for $6 million, CBS News is being sued for $6 million and the photographer responsible for the original posting of the picture is being sued for $600,000. The lawsuit alleges three things: defamation of character, emotional distress for the teenager, and invasion of an underage child’s privacy.
