Johnny Sanchez, 23, of Worcester, Massachusetts, was in Worcester Central District Court on January 4 being charged with assault and battery on a child causing serious bodily injury and assault and battery on his live-in girlfriend’s son, three-year-old Damian Pomalez. Court records state that the child was beaten so severely that he “was left fighting for his life” and required surgery to treat a perforated bowel and needed mouth tubes to survive the surgery, according to Mass Live.
Damian’s mother, Emalie Almodovar, characterized her son as smart, kind and loving and that he gave a thumbs up to the hospital medical staff after his mouth tubes were removed following his life-saving surgery. Damian was admitted to Memorial Medical Center-University Campus last week and remains in intensive care.
Court records state that Damian’s perforated bowel resulted from Sanchez repeatedly striking Damian in the stomach. Police say that the assault on Damian most likely took place on the morning of December 30 while Sanchez was watching Damian while Almodovar was at work. Sanchez and Almodovar had been living together for about six months.
The day after Sanchez babysat for Damian, the child complained to his mother about stomach pains. When Almodovar took her three year old to see the doctor, court records shared by Mass Live stated that “doctors found the boy’s injuries were likely inflicted on him.”
The Telegram in Worcester reported that after police were called to the doctor’s office, that Damian had to be transported to the emergency room at UMass Memorial Medical Center “with fever, vomiting and serious abdominal injuries.” Police said that based upon their investigation and timeline of events, Sanchez is the only one who could have assaulted the child.
The judge overseeing the hearing ordered Sanchez to be held without bail. Sanchez is due back in court on Friday. The Telegram also reported that Damian’s grandfather “had to be forcibly removed from the courtroom after an outburst during Sanchez’ hearing.”
There is a history of domestic violence at the Sanchez- Almodovar household. In November, Sanchez was charged with domestic assault against Almodovar, assaulting her with a knife, threatening her and vandalizing her automobile. He was released on his own recognizance in that case.
The mom also told the cops that on December 18 Sanchez threatened her again and then grabbed her by her throat. When Sanchez appears in court this Friday, the judge will be deciding whether or not to revoke his bail on the November domestic assault charge.
